ACADEMIC LICENSE AGREEMENT FOR USE OF SOFTWARE MAIN Software 4 Crystallography, Dusan and Dragica Turk, d.n.o. Povsetova 33 1000 Ljubljana Slovenia as licensor and .......... as licensee, agree to sign the following academic license agreement for computer software MAIN: This academic license agreement for the MAIN (copyright by S4C d.n.o. Ljubljana) distributed on a distribution media gives right to use the licensed software to the licensee and his contemporary coworkers and guest scientist under the following conditions: This license agreement is valid when it is signed by both parties and the license fee (800 EURO for Europe and 1000 USD for the rest of the world) has been paid, if not otherwise agreed. (1) The licensee has no right to give or sell the licensed software in any form to any other person or institution. (2) The program(s) will be used in academic and non-profit research institutions located at the licensee research institution only on computers with the first 3 TCP/IP numbers equal to: ..................... corresponding to the local domain name: ..................... The fourth number is free. The given license is given to unlimited number of computers and kind of hardware, assuming that an executable file can be provided. If the licensee has access to a supercomputer placed at some other position, this computer should be should explicitly included by its TCP/IP number to this license agreement. (3) The licensor is obliged to provide software maintenance during period of two years, starting by the date when the first license agreement has been signed. Software maintenance includes upgrades of software, bug removal and customer support by the program usage. After this period, licensee may still continue using the software, however the licensor is obliged to continue software maintenance only when an additional license agreement prolongs it. (4) Program usage will be cited in any publication of scientific results where it was applied. The current reference is: D. Turk: Ph.D. Thesis, 1992, TU Muenchen. (5) The program bugs will be reported to the author. (6) The licensor is not liable for any kind of mistake(s) or any possible damage caused by the program(s) usage, including when they are result of a program bug.
